ISM saddles, LLC one year consumer limited warranty
Original and genuine ISM SADDLES, LLC products are warranted to be free from defects in materials or workmanship for one year from the date of purchase. Within this period, ISM SADDLES, LLC will, at its sole option, repair or replace any components that fail in normal use. Such repair shall be your sole and exclusive remedy for any breach of warranty. Such repairs or replacement will be made at no charge to the customer for parts or labor, provided that the customer shall be responsible for any transportation cost. This warranty does not apply to: (i) cosmetic damage, such as scratches, nicks and dents; (ii) damage caused by accident, abuse, misuse, water, flood, fire, or other acts of nature or external causes; or (iii) damage to a product that has been modified or altered without the written permission of ISM SADDLES, LLC. In addition, ISM SADDLES, LLC reserves the right to refuse warranty claims against products or services that are obtained and/or used in contravention of the laws of any country. The warranty extends from the original date of purchase, to the original owner and is not transferable. THE WARRANTIES AND REMEDIES CONTAINED HEREIN ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY LIABILITY ARISING UNDER ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, STATUTORY OR OTHERWISE. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, WHICH MAY VARY FROM STATE TO STATE. IN NO EVENT SHALL ISM SADDLES, LLC BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, WHETHER RESULTING FROM THE USE, MISUSE, OR INABILITY TO USE THIS PRODUCT OR FROM DEFECTS IN THE PRODUCT. SOME STATES DO NOT ALLOW THE EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. All ISM Saddles purchased through an authorized ISM dealer (either online or retail establishment), must be returned to the place of purchase. All ISM Saddles purchased online through ismseat.com must be returned to ISM Saddles, after obtaining an RA (Return Authorization) tracking number. Packages that do not have an RA on the outside of the shipping box will be refused. Securely pack the product and include a copy of the original sales receipt along with the original packaging, which is required as the proof of purchase for warranty repairs. Write the RA number clearly on the outside of the package. Send the product, freight charges prepaid, to ISM SADDLES, LLC Attn: Warranty Department. This Limited Warranty does not cover:
- Non-genuine ISM products including, without limitation, counterfeit saddles.
- Normal wear and tear.
- Improper installation or installation of accessories or components not compatible or not originally intended to be used with an ISM product.
- Failure or damage due to neglect, abuse, misuse or accident.
- Products purchased through online auctions and/or online platforms (not including verified online purchases made directly from ISM Saddle’s online store) are not eligible for warranty coverage.
To Obtain Warranty Service Please Complete These Two Easy Steps: To obtain warranty service, contact e-mail ISM SADDLES, LLC at [email protected]. You will need to provide the saddle model, date of purchase, where you purchased your product, original receipt, a photo of the problem, a description of the claim, your return shipping address and a daytime phone number. After your request is considered and deemed a valid warranty you will be issued a Return Authorization (RA) number to be posted on the outside of the box. You may be asked to submit your saddle for inspection prior to a warranty determination being made. A Return Authorization (RA) number will be provided and shall be placed on the outside of the shipping package. If it is deemed that you have purchased a counterfeit saddle, we will notify you of determination. We will be unable to return the saddle to you. No refund or replacement saddle will be provided. If your saddle is an original ISM Saddle but, does not meet the criteria for a warranty, it will be returned to you at your expense. ISM Saddles may be returned or exchanged within 30 days of purchase date. All saddles being returned or exchanged must be in 100% resalable condition, with a copy of the receipt and the packaging included.
